Umar, former Kaduna Gov. sues MTN for unsolicited SMS, deductions

Former military Governor of Kaduna State, Abubakar Umar, has directed his legal team to begin a legal battle against leading telecoms group, MTN Nigeria for unsolicited messages and alleged fraudulent deductions.

The move is coming barely one week after an Abuja based businessman had won a related suit against Airtel in a High Court. The trial Judgewhile delivering his judgment, awarded N5m damages to the complainant to be paid by Airtel and warned the company to desist from such practice, saying any related case on it again may land the managing director in jail.

In his planned prayers to the Court, Umar will tell the court that the practice has continued despite repeated assurances that it will not happen again.

In a statement, the former Governor explained that he has been receiving unsolicited messages accompanied by deductions of money from his telephone line, adding that “I have briefed my lawyers.”

Before now, the regulator, Nigerian Communications Commission (NCC), had told Nigerians of a code to send against any number or SMS that is not wanted, but many subscribers that have tried the code said the code does not go when sent.

It was not clear if the frustration coming from the inability of the code to perform the duty it was meant for that aggrieved subscribers are now heading to court and coming back with victories after all.
